SAFER DRIVING

Today’s news brought a story we just could not ignore.

Using Vehicle-to-Vehicle Communication technology (V2V), automobiles will be able to alert drivers of trouble ahead and/or take defensive actions on their own.

The Vehicle-to-Infrastructure technology (V2I), in conjunction with the Global Positioning System (GPS), will alert drivers to road work, traffic delays, etc and may even provide alternate routes.

If this technology becomes a reality, V2V should reduce the number of automobile accidents. If so, people will suffer fewer injuries and car repairs will be greatly reduced. Under these circumstances, one would expect to see insurance rates decline.

Along the same lines, the V2I technology should reduce road congestion, save gasoline costs, and generally reduce the frustration and inconvenience of traffic back-ups.

Apparently, safer driving could be available nationwide in 10 to 20 years.

Attorney Licensing

In most states, Attorneys are required to take and pass a rigorous bar examination in order to be licensed to practice law in that state. With few exceptions, a license to practice law in one state does not permit a lawyer to practice in another state. As such, attorneys take the bar exams offered in each state they intend to practice in on a regular basis.

Also, lawyers must be admitted into the Federal Bar in order to practice law in the federal courts.

In addition to taking and passing the state bar examination, attorneys are required to attend educational programs to maintain their licenses. In Ohio, for example, lawyers must attend 24 hours of continuing legal education (CLE) every two years.

At Cubbon & Associates, all of our lawyers are fully licensed in Ohio and the federal court. In addition, Stuart F. Cubbon is licensed in Michigan and Florida. Kyle Alison Cubbon and James E. Yavorcik hold Michigan licenses.

All Cubbon attorneys double the continuing legal education requirement and attend 24 hours of CLE per year.

Supporting the Home Team

When the Toledo Mud Hens played their opening, exhibition game against the Detroit Tigers (April 4, 2012), our firm closed our doors for a half day and took our staff to 5/3 Field to cheer on the home team.

Sitting with 12,000 other fans on a glorious, sunny day, we cheered, sang and thoroughly enjoyed the game and our neighbors.

Toledo is our town.  We live here, were educated here and have raised our families here.  We support this community as members of many volunteer organizations.

We care about Toledo and the surrounding communities.  We give back.  We support the home team!

Motorcycle Safety


This spring, many people are out enjoying the beautiful days riding on their motorcycles. It is important to “share the road” so accidents and personal injuries are avoided. Motorcyclists have equal rights to travel within their entire lane. On the other hand, motorcyclists must not swerve in and out of traffic.

Bicycle Safety

Share the Road

It is motorcycle season.  And it seems like there are more motorcycles on the road this summer than in years past.  Maybe it is the price of gasoline?  Maybe it is the good weather?  For whatever reasons, our motorcycle riding friends are out on the road and we want them to be safe.

DISTRACTED DRIVING

There is a growing body of scientific research that unquestionably supports the obvious fact that texting, cell-phone talking, and playing with hand-held devices is just plain DANGEROUS. Hands free talking may be as dangerous as hand held talking. We strongly encourage our readers to put the phone aside while driving. If you must take or make a call, consider pulling off the road. Please pay attention to your driving. Make sure you are following the rules and be on the lookout for those whose minds are on their conversations rather than the road.

INSURANCE COVERAGE ESTABLISHED FOR THE BLUFFTON UNIVERSITY BASEBALL TEAM

Cubbon and Associates attorney Jim Yavorcik argued successfully on behalf of client Tim Berta in a case decided recently by the Ohio Supreme Court over the bus crash involving the Bluffton University baseball team.

The Court ruled (5-2) that the driver of the charter bus was covered under a policy issued to the university because the University “hired” the bus and the driver was operating it with the University’s permission at the time of the crash.

Earlier this month, the Court refused to reconsider the ruling. The effect of the decision is to create a pool of $21 million dollars to cover the claims of 33 passengers on the bus.
Seven persons, including the driver were killed in the crash and many were seriously injured

Jim and another Toledo lawyer argued the case in the Ohio Supreme Court on behalf of the victims and their families.

Window Safety

Unfortunately, each year we receive calls about children who fell out of windows. Typically, the child is young. Generally, the child was not being supervised. Almost always, a screen gave way.

In an effort to help prevent these traumatic falls through education, Cubbon & Associates shares tips from the National Safety Council:

• Avoid placing furniture young children can climb on near windows.
• Do not lean on screens or rely on them to prevent a window fall. Insect screens are designed to keep bugs out, not to keep children in the home.
• Supervise children to prevent them from playing near windows, balconies or patio doors.
• Install building code-compliant devices such as window guards (with quick-release mechanisms in case of fire).
• Teach your children how to safely use a window to escape during an emergency.

New Lawyer Training

Kyle Alison Cubbon spoke to new lawyers at the Toledo Bar Association (www.toledobar.org) New Lawyers Training seminar on April 9, 2011. The specific topic was Law Office Management. Balancing the Ohio Rules of Professional Conduct with the daily realities of a law practice can be challenging but with thought, planning, and a strong adherence to an ethical practice, the challenge is rewarding and fulfilled.
